1. PARTIES
1.1 This agreement is entered into between:
The Seller/Creator – an independent content creator who produces and offers digital content through the platform operated by Ballistic Blue Limited trading as DirtyKnickers.com, and
The Buyer – a registered user who purchases access to content, messages, or digital goods offered by the Creator through the platform.
1.2 Ballistic Blue Limited operates the platform and facilitates payments but is not a party to the transaction between the Creator and the buyer, except as a payment and hosting intermediary.
2. NATURE OF THE AGREEMENT
2.1 By purchasing a pay-per-view content or other digital content from a Seller, the buyer enters into a direct agreement with that seller for the limited access to and viewing of digital content.
2.2 The buyer is granted a personal, non-transferable, non-commercial licence to access the content for private viewing only. Ownership of all intellectual property rights in the content remains with the Seller/Creator.
3. PAYMENT AND PLATFORM FEES
3.1 All payments for content are processed through the platform operated by us.
3.2 The platform may deduct service fees or commissions before distributing the remaining amount to the Seller.
3.3 The buyer agrees to pay all charges associated with the purchase of subscriptions, digital content, or other services offered by the Creator. Payment processing may be handled by independent providers such as Epoch, CCBill, or SegPay.
4. PERMITTED USE OF CONTENT
4.1 Content purchased or accessed through the platform is intended for personal use only.
4.2 The Buyer must not:
- Record, reproduce, distribute, or publish content;
- Share content with third parties;
- Upload content to other websites;
- Sell or commercially exploit the content.
4.3 Any unauthorised distribution may constitute copyright infringement and may result in account suspension, legal action, or both.
5. SELLERS/CREATOR RESPONSIBILITIES
5.1 Creators agree that:
- All individuals appearing in content are 18 years of age or older;
- Content is created with the full consent of all participants;
- The Creator owns or has the legal rights to distribute the content;
- Content complies with the platform’s policies and applicable laws.
5.2 Creators remain independent contractors and are responsible for their own taxes, legal compliance, and obligations relating to their content.
6. REFUNDS AND CANCELLATIONS
6.1 Unless required by applicable law, purchases of digital content and subscriptions are generally non-refundable once the content has been accessed.
6.2 However, we may review refund requests in cases involving:
- Billing errors;
- Fraudulent transactions;
- Technical access issues.
7. PROHIBITED CONDUCT
7.1 Buyers must not:
- Harass or threaten creators;
- Attempt to obtain personal contact information;
- Record or redistribute content;
- Upload or request illegal content.
7.2 Violations may result in immediate account suspension or termination.
8. PLATFORM ROLE
8.1 We provide the technology platform that enables creators and buyers to interact and transact.
8.2 The Platform:
- Hosts content;
- Processes payments;
- Enforces community standards.
8.3 However, we do not create the content itself and does not control creator–Buyer interactions beyond platform policies.
9. LIMITATION OF LIABILITY
9.1 To the fullest extent permitted by law, we shall not be liable for disputes between sellers and buyers relating to the content provided, except where required by applicable consumer protection laws.
10. GOVERNING LAW
10.1 This agreement shall be governed by the laws applicable to Ballistic Blue Limited and the jurisdiction in which it operates, unless otherwise required by consumer protection legislation.
11. ACCEPTANCE
11.1 By purchasing or accessing content from a Creator through the platform, the Buyer confirms that they:
- Are at least 18 years old;
- Agree to the terms of this agreement;
- Will comply with the platform’s policies and applicable laws.
