This sets out what is and is not permitted on the DirtyKnickers.com website and forms part of your agreement with us. The Defined Terms in this Policy have the same meaning as those in Our Terms and Conditions
1. Overview
This policy applies to all purchases of physical goods made through the platform (“Platform”).
The Platform operates strictly as an intermediary marketplace. Sellers list and sell items directly to buyers. The Platform does not own, supply, or take title to goods and is not the seller of record for physical items.
All contracts for the sale of goods are formed directly between the buyer and the seller.
2. Seller Responsibilities
Each seller is solely responsible for:
- Processing and dispatching orders within stated handling times
- Providing accurate item descriptions and shipping details
- Ensuring goods are packaged and shipped appropriately
- Providing tracking information where available
- Complying with all applicable laws, including consumer protection, export, and customs regulations.
3. Shipping Methods and Costs
Shipping methods, apart from the Discreet Service, costs, and delivery estimates are determined by individual sellers and displayed at checkout.
The Platform does not:
- Set shipping prices for normal delivery
- Control delivery services
- Guarantee delivery timeframes.
4. International Shipping
Sellers may ship internationally depending on their settings. Customs duties and declaration forms are the responsibility of the Buyer and Seller.
Delivery times vary based on:
- Destination
- Shipping method
- Customs processing.
Delays caused by customs or carriers are outside the control of the Platform and Seller.
5. Customs, VAT, and Duties
5.1 Intermediary VAT Position
The Platform acts solely as an intermediary for physical goods. Accordingly:
- The seller is the supplier of the goods.
- The seller is responsible for any VAT obligations on the sale.
- The Platform does not normally charge VAT on the sale of goods, only on its service fees where applicable.
- Where applicable the Platform may, by local laws, be required to charge VAT or other tax and account that to the relevant authority. We will undertake to do so where required.
5.2 UK Imports (≤ £135)
For goods imported into the UK with a value of £135 or less:
- UK VAT may be due at the point of sale.
- The Platform is responsible for charging and accounting for VAT, where required.
5.3 UK Imports (> £135)
For goods over £135:
- Import VAT and duties are typically collected at the border.
- The buyer is responsible for these charges before delivery.
5.4 Buyer Responsibility
Buyers are responsible for:
- Import VAT
- Customs duties
- Any handling or clearance fees.
These are not included in item or shipping prices unless explicitly stated.
6. Delivery and Risk
Delivery is considered complete when the item is delivered to the address provided by the buyer.
Risk in the goods passes according to applicable law between Buyer and Seller. The Platform does not assume risk of loss or damage in transit.
7. Returns and Refunds
7.1 General Principle
All returns and refunds requested will be administered by the Platform and the Platform will liaise with the Buyer and the Seller, as the Seller is the legal supplier of the goods.
The Platform is not a party to the sale but will assist in dispute resolution.
7.2 Seller Return Policies
Each Seller must clearly state their return policy, including:
- Whether returns are accepted
- Return timeframes (e.g. 14 days)
- Conditions of return (unused, unworn, etc.)
- Who pays return shipping.
Buyers should review the seller’s return policy before purchasing.
7.3 Faulty, Misdescribed, or Not Received Items
Under UK consumer law, Buyers may be entitled to remedies if goods are:
- Faulty
- Not as described
- Not received.
In such cases:
- The seller is responsible for providing a remedy (refund, replacement, or repair where applicable).
- Buyers should contact the seller first to resolve the issue and if not resolved contact Us.
7.4 Change of Mind Returns
For non-faulty items:
- Returns are subject to the Seller willing to accept the goods back.
- Sellers are not required to accept returns unless they have agreed to do so.
7.5 Refund Processing
Refunds, where agreed will typically be issued to the original payment method.
The Platform does not process refunds directly unless required under its dispute resolution procedures.
7.6 Return Shipping
Unless the item is faulty or misdescribed:
- The Buyer is usually responsible for return shipping costs.
- The Item should use the same return address as is stated on the packaging. Return addresses can vary from Seller to Our Hubs where the Discreet Service is used.
7.7 Platform Dispute Assistance
If a Buyer and Seller cannot resolve an issue:
- The Platform may, at its discretion, review the dispute.
- The Platform may take action in accordance with its Terms & Conditions.
However, the Platform does not assume liability for the underlying transaction.
8. Incorrect Addresses
Buyers must ensure shipping details are accurate.
Sellers are not responsible for failed delivery due to incorrect or incomplete addresses and additional shipping charges may apply.
9. Restricted and Prohibited Items
Sellers must comply with all applicable laws regarding restricted goods.
Buyers are responsible for ensuring items can be legally imported into their country. The Platform is not liable for items seized or delayed by customs.
10. Platform Role and Liability
The Platform acts solely as an intermediary for physical goods and:
- Does not take ownership of goods
- Does not control shipping or delivery
- Is not responsible for Seller performance.
Liability for the sale, shipment, and condition of goods rests with the Seller.

We may update this policy at any time. Updates will be posted with a revised effective date.
